Probative

In a legal context, “probative” refers to evidence that is relevant and tends to prove a fact in dispute. Probative evidence is evidence that has a tendency to prove or disprove a fact that is material to the case at hand. This evidence can be used to establish or refute a fact that is necessary to the outcome of the case. The probative value of evidence is weighed against its prejudicial effect. The judge will decide whether the evidence is admissible and relevant to the case.
